Buying a house - The Scottish System. (This is general information and you should talk to a solicitor for up to date guidance)
When buying a house in Scotland, especially if moving from England, you should be aware in your own interest that there are differences in procedure. In England there are 2 stages – making an offer, and exchanging contracts. In Scotland there is only one stage, or at least the 2 stages are almost literally combined – when your offer is accepted by the seller, you are both committed to proceed with the transaction! In Scotland the ‘missives’ are usually signed by the solicitors and you must ensure that your solicitor is acting under your instructions and that he understands your situation and whether or not you are in a position to proceed with a purchase. Once your offer is accepted you are committed to proceed with the purchase – and failure to complete the deal can result in you being liable for very heavy costs if losses or a re-sale occur. Because of the difference in speed of transactions north of / south of the border, if an English solicitor is involved in the sale of a property to finance a purchase in Scotland he should be instructed to ‘get a move on’.
The Price When the housing market is healthy, a house is usually offered for sale in Scotland with ‘Offers Over’ price. Estate agencies juggle this indicator making it low enough to attract attention but expecting offers to be substantially higher (in the order of perhaps 20%). In periods of sluggish sales a lower offer may occasionally be accepted. A seller may offer property at a ‘fixed price’. This does not necessarily mean it will sell at that price, but the seller may be in a hurry and the financial position - cash available?) of the potential buyer may have greater influence on acceptance than the magnitude of the offer. The Survey As surveys are expensive, an offer is sometimes accepted ‘subject to survey’ if a verbal offer is high enough and agreement is reached to have a survey carried out within a very short timescale – a few days at most. In this case it is best for the purchasers solicitor to arrange the survey rather than wait for your lender to get round to it. This situation may be overtaken by the recent legislation regarding ‘Home Information Packs’. Closing Dates Sometimes a ‘closing date’ is set. This means offers must be formally made by the given date. Since bids are ‘secret’ this should in principle reduce the possibility of ‘gazumping’ but also means that buyers are bidding blind and may incur costs with no certainty of a successful purchase. You can ask your solicitor to make a ‘note of interest’ to the seller which means you will be notified once a closing date has been set. Because of the level of commitment required by the Scottish system, you should always ensure that you will be in a position to proceed prior to making a formal offer unless your offer is ‘subject to survey’.
